The parties agree that their relations will be governed exclusively by the present contract, to the exclusion of any condition previously available on the site.
In the absence of such a condition, it shall be deemed to be governed by the practices in force in the distance selling sector whose companies are based in France.
These general terms and conditions of sale may be modified from time to time. The terms and conditions applicable are those in force on the Site at the date your order is placed.

It is possible that the colors of the photograph may differ slightly from the original model, despite the utmost care taken in processing the photos. The photographs are provided for information only.
By confirming your order, You accept all of these general terms and conditions of sale, which are available on https://www.my-qamis.com/, and acknowledge that You are fully aware of them, thereby waiving the right to invoke any contradictory document, as the act of purchasing implies acceptance of these general terms and conditions of sale. This confirmation and all data recorded by Us shall constitute proof of our transactions.
Article 2 : Prices
Prices are quoted in euros and are deemed to be net, excluding delivery charges.
Prices are quoted in euros, VAT not applicable, article 293 B of the French General Tax Code.
We reserve the right to modify our prices at any time, but We undertake to apply the rates in force, which will have been indicated to you at the time of your order.
All our prices are defined in euros.
The price is payable in full, in a single instalment, when the order is placed. All orders are invoiced and payable in euros. For deliveries outside mainland France, any customs duties or local taxes are the responsibility of the recipient.
Article 3 : Order
We undertake to accept your order under the terms of these general terms and conditions of sale.
The customer may place an order online:

or from the order form (printed via the site);(not active)
Any order implies acceptance of the prices and description of the products available for sale.
Any order therefore implies the buyer's unreserved acceptance of these general terms and conditions of sale.
Please note that We will fulfil your order within the limits of our available stocks or subject to our suppliers' available stocks.
When you place your order, We will inform you of the availability of the products you wish to purchase. However, if, despite our vigilance, the products prove to be temporarily unavailable (out of stock, reissue, etc.) after your order, We will inform You by e-mail and invite You to cancel or modify your order. If the products prove to be permanently unavailable (out of stock, unreleased works, etc.) after you have placed your order, we will automatically cancel your order and inform you by e-mail.
For bulk orders, please contact us, leaving the details of the order in the "contact" section, indicating the quantities and the references of the products concerned.
Payment by cheque is equivalent to taking an option. If you wish to pay by cheque, it must be received within one week for us to validate your order. To ensure that your order is maintained, please send us your cheque as soon as you have placed your order. For faster and more secure processing, please specify your order number on the back of the cheque.
Your option remains valid for 7 days from the date of order. After this period, if we have not received your cheque, your option will be automatically cancelled. Your option will not be validated until we have received your cheque.
If, for any reason, the customer cancels the order or any part of it, after we have sent the order or the customer has received the package, the delivery charges will be due (Applicable for free charges). Return postage will also be charged (Colissimo). After receipt of the parcel, the products must be in very good condition for the refund to be effective. ( Sealed item...).
Customers making too many unpaid orders ( fictitious orders ) will be automatically blocked.
article 4 : Payment
The price invoiced to the customer is the price indicated on the order confirmation sent by lmy-qamis.com. (Except for cash on delivery)
Payment for your purchases is made:
" By credit card via Paypal. We accept Carte Bleue, Visa and Eurocard/Mastercard.
" By cheque. Cheques must be issued by a bank domiciled in metropolitan France or Monaco. As of January 1, 2002, only cheques made out in euros will be accepted.
Concerning cheques: Cheques are cashed on receipt.

lmy-qamis.com also reserves the right to refuse any order from a customer with whom a dispute exists.
Article 5 : Delivery
Unless otherwise stipulated, delivery is made to the address You indicated when placing your order. If You choose to pay by cheque, the order will only be processed on receipt of the cheque, and delivery times will be calculated accordingly.
La Poste and the "Colissimo Suivi" service
To reduce transport costs and the risk of loss as much as possible, all small and medium-sized products are sent by Colissimo Suivi. In addition to being cost-effective, this service delivers within 48 hours anywhere in France, and gives you the option of collecting your order from a post office close to the delivery address if you are absent from the original delivery address when the letter carrier arrives. Specifically, if you are absent on the day of delivery, your letter carrier will leave a notice in your letterbox, allowing you to collect your parcel from your post office during opening hours, within 15 consecutive days.
Colissimo Suivi is a highly reliable service. However, we cannot be held responsible for any loss or extension of delivery times due to the carrier, particularly in the event of a strike.
Delivery times
The delivery times indicated at the time of ordering are only an estimate made by our delivery partners and in no case a guarantee. The My Qamis site cannot be held responsible for any delays in delivery. No claim for compensation can therefore be made.
Delivery times are in the region of 48 working hours (for France) by Colissimo as soon as your order has been sent (if a product is out of stock, we will inform you immediately and offer you an exchange or refund).
The default delivery method is Colissimo parcel post. We reserve the right to change the delivery method, with a refund of the difference. You can choose your type of shipment by sending us an e-mail to find out the exact cost of delivery. For example, if you are sending a book, you can request that it be sent by post.
The delivery time indicated when the order is placed is given as an indication only and is in no way guaranteed.
Consequently, any reasonable delay in the delivery of products will not entitle the purchaser to:
damages;
cancellation of the order.
The Buyer outside France assumes full responsibility for payment of VAT (if applicable), export taxes and charges & any processing fees relating to the purchase.
The risk of transport and security is assumed in full by the buyer.
The goods must be delivered within a maximum of 30 days from the day following the day on which the consumer sent the order for payment, failing which the contract will be rescinded and any sums paid will be reimbursed;
The right reflexes to adopt when receiving goods in the event of damage:
In the presence of the delivery person or at the post office:
- The apparent state of the package
If the delivery is not in conformity
- Mention the problem encountered on the delivery note:
damaged packaging, breakage of the guarantee strip, leakage...
- Refuse the package, please clearly indicate the reason(s)
- https://www.my-qamis.com/en/ is in no way responsible for indirect damage (as long as you accept the package)
. Please note: the mention "under reserve" (or "unpacked") is not accepted as a guarantee for the recovery of damages. (The reception of the parcel is the responsibility of the receiver).
In the event of the parcel being lost, damaged, opened or stolen, https://www.my-qamis.com/en/ cannot be held responsible. The customer should inform us and also contact the post office on 3631 to make a claim.
For all claims, the consumer must send a letter by any means, including email.
For any reason whatsoever packages returned to sender, without the fault be attributed to https://www.my-qamis.com/, the cost of reshipment will be charged to the customer or make a claim with the service of the post 3631 to obtain compensation. (see conditions of the post office).
Please note the correct country when ordering, otherwise your order will be cancelled.
If we omit a product from your parcel (by mistake), we will reimburse you for the amount of the missing product.
Article 6: Withdrawal period
Within 14 working days of delivery of the order, the consumer has the right to return, exchange or obtain a credit note for any products that do not suit him/her.
- The product must be returned in good condition, complete and unworn.
- The order reference and the refund request must be clearly stipulated in the shipment.
- The product must be in its packaging, with its label and in very good condition
- The product must be returned by Colissimo with signature to Librairie le Savoir 35 rue de Paris 91100 Corbeil Essonnes (return postage to be paid by the customer)
- If for any reason the customer cancels his order or a part of it, the delivery charges will be due (Applicable for the offered charges, if the customer benefited from offered charges conditioned to an amount, if this one came to cancel his order or to a part of his order the offered delivery charges will be due and deducted from the refund).
If one of these conditions is not met, the refund cannot be made.
Article 7: Conclusion of online contract
Prior formalities
Before confirming his acceptance of the offer, the customer checks:

In this respect, force majeure means any external, unforeseeable and irresistible event within the meaning of article 1148 of the French Civil Code.
Article 9: Retention of title
lmy-qamis.com retains ownership of the goods sold until full payment of the price, in principal and in accessories.
In this respect, if the purchaser is subject to receivership or compulsory liquidation, https://www.my-qamis.com/en/ reserves the right to claim, within the framework of the receivership proceedings, the goods sold and remaining unpaid.
Article 10 : Applicable law
In the event of a dispute, an amicable solution will be sought before any legal action is taken. The prior search for an amicable solution does not interrupt the time limits for taking action in warranty.
Failing amicable resolution, the dispute will be brought before the Evry Commercial Court.
All relations arising from connection to and/or use of the present site are subject to French law.
